Account Creation

Vehicle Listings

CarHubster is a marketplace platform that connects buyers and sellers. We do not own, sell, or warranty the vehicles listed on our platform. All vehicle transactions are between buyers and sellers/dealers.

Seller Obligations

• Provide accurate vehicle information and photos
• Disclose all known defects or issues
• Honor the listed price and terms
• Complete transactions in good faith
• Comply with all applicable laws and regulations

Buyer Responsibilities

• Inspect vehicles before purchase
• Verify vehicle condition and history
• Complete due diligence on sellers
• Honor purchase commitments
• Arrange payment and delivery as agreed

CarHubster partners with third-party lenders, insurance providers, and warranty companies. These services are subject to additional terms and conditions from those providers. We do not guarantee approval for any financial services.

Payment Processing

• All payments are processed through secure, PCI-compliant payment processors
• You authorize us to charge your payment method for applicable fees
• Refunds are subject to our return policy
• You are responsible for all taxes and fees

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Post false, misleading, or deceptive content
• Engage in fraudulent transactions
• Harass, threaten, or abuse other users
• Attempt to gain unauthorized access to systems
• Use automated tools to scrape or copy content
• Interfere with the proper functioning of the Service
• Impersonate other users or entities
• Sell or transfer your account

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We do not warrant that:

• The Service will be uninterrupted or error-free
• Vehicle listings are accurate or complete
• Vehicles meet any particular quality standards
• Transactions will be completed successfully
• Third-party services will be available

You assume all risks associated with using the Service and purchasing vehicles through the platform.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• CarHubster shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid to us in the past 12 months
• We are not liable for actions of sellers, dealers, or third-party service providers
• We are not responsible for vehicle defects, misrepresentations, or transaction failures

You agree to indemnify and hold harmless CarHubster, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your vehicle listings or transactions

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except for claims that may be brought in small claims court. You waive your right to a jury trial and to participate in class actions.
